Terms of Service

1. Agreement to the Terms

If you do not agree to these Terms, do not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.

Our Privacy Policy explains how we handle personal data and is incorporated by reference.

2. Eligibility

You must be at least 16 years old (or the minimum age of digital consent in your country, if higher) to use the Service. You must provide accurate registration information and keep it updated.

3. Accounts and security

• You are responsible for activity under your account and for keeping credentials confidential.
• Notify us promptly at irfansaeed.kg@gmail.com if you suspect unauthorized access.
• We may suspend or terminate accounts that violate these Terms, create risk, or remain inactive for an extended period after notice when practical.
• You may export your data and delete your account from Settings, subject to residual backups and legal retention described in the Privacy Policy.

4. The Service

DayMirror helps you reflect on how time was spent, plan work, capture notes, and (optionally) use AI assistance and Google Calendar context. Features may change as we improve the product. We do not guarantee uninterrupted availability, and we may modify, suspend, or discontinue features with reasonable notice when practical.

The Service is a productivity and reflection tool. It is not medical, mental health, legal, accounting, or professional advice.

5. Plans, trials, and billing

We may offer free access, trials, waitlists, or paid plans (for example Silver, Gold, or Diamond tiers described on the marketing site). Prices, included features, and limits may change. If paid billing is enabled:

• fees are charged in the currency and interval shown at purchase;
• unless stated otherwise, subscriptions renew until canceled through the billing provider or in-product controls we provide;
• taxes may apply; refunds follow the policy stated at purchase or required by law;
• failure to pay may result in downgrade or suspension of paid features.

During periods when we intentionally leave paid gating off, additional features may be available without charge. That does not create a permanent right to those features once gating or billing is enabled.

6. Acceptable use

You agree not to:

• break the law or infringe others’ rights;
• upload malware, attempt unauthorized access, scrape the Service in a way that harms availability, or probe vulnerabilities except through coordinated disclosure;
• reverse engineer the Service except where mandatory law allows;
• misuse AI or voice features to generate illegal, abusive, or highly sensitive content you are not authorized to process;
• interfere with other users’ accounts or use the Service to send spam;
• misrepresent your identity or affiliation in a deceptive way.

7. Your content

You retain ownership of content you submit (hour notes, tasks, notes, audio you record, and similar “User Content”). You grant us a worldwide, non-exclusive license to host, process, transmit, display, and create derivative technical copies of User Content solely to operate, secure, and improve the Service, including providing AI features you request.

You represent that you have the rights needed to submit User Content and that it does not violate law or third-party rights. We may remove content that violates these Terms.

8. AI features disclaimer

Optional AI features may misunderstand speech, invent details, or suggest incorrect actions. You are responsible for reviewing AI output before relying on it. We are not liable for decisions you make based on AI suggestions. Voice capture requires browser microphone permission and is not required to use the Service.

9. Google services

Google sign-in and Google Calendar are optional integrations governed also by Google’s terms and policies. Calendar data is used as planning context. You can disconnect Google access in Settings or via your Google Account. We are not responsible for Google’s availability or changes to Google APIs.

10. Our intellectual property

The Service, including software, design, trademarks, and documentation (excluding User Content), is owned by us or our licensors. Except for the limited right to use the Service under these Terms, no rights are granted. You may not copy, brand-as-your-own, or exploit our marks or product UI without permission.

11. Third-party services

The Service depends on third-party infrastructure (hosting, databases, auth, analytics, AI providers, and Google). Their terms and outages can affect the Service. Links to third-party sites are provided for convenience only.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT CONTENT (INCLUDING AI OUTPUT) WILL BE ACCURATE OR COMPLETE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) FIFTY US DOLLARS (USD $50), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

14. Indemnity

You will defend and indemnify us against claims, damages, and expenses (including reasonable legal fees) arising from your User Content, your misuse of the Service, or your violation of these Terms or applicable law, to the extent permitted by law.

15. Termination

You may stop using the Service and delete your account at any time. We may suspend or end access if you violate these Terms or if we discontinue the Service. Provisions that by nature should survive (including ownership, disclaimers, limitations, and indemnity) will survive termination.

16. Changes to these Terms

We may update these Terms. We will revise the effective date and, for material changes, provide notice in the product or by email when appropriate. Continued use after changes become effective constitutes acceptance, except where mandatory law requires another process.

17. Governing law

These Terms are governed by the laws of Pakistan, without regard to conflict-of-law rules, except where mandatory consumer protections in your country of residence require otherwise. Courts in Pakistan will have non-exclusive jurisdiction, subject to those mandatory protections.

18. Miscellaneous

• If a provision is unenforceable, the remaining provisions stay in effect.
• Failure to enforce a provision is not a waiver.
• You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
• These Terms are the entire agreement between you and us regarding the Service and supersede prior agreements on the same subject.
